SENIOR MOVES & ESTATES

Inherited a home? Start with ownership and authority.

Understand the first steps in selling an inherited Long Island home, from title and estate authority to preparation and pricing.

Confirm how the property is owned

Start with the deed and a title review. Do not assume every inherited home follows the same process: the ownership arrangement and any trust can affect what happens after death. Ask an estate attorney to identify the correct path before anyone promises a sale or signs a listing agreement.

Probate and administration are different processes

Probate addresses a will through Surrogate’s Court. An administration proceeding generally applies when there is no will. A person named executor in a will is not automatically appointed simply because their name appears there. Counsel can explain the required appointment and documents for the estate.

Understand the documents before setting a deadline

Letters Testamentary and Letters of Administration document court-appointed roles. Have the attorney and title professionals confirm the authority and restrictions that apply to the proposed sale, including whether additional court approval is required. Family agreement alone is not a substitute for legal authority.

Prepare the property while the legal work proceeds

With the appropriate authorization, inventory belongings, protect documents, check insurance and arrange necessary maintenance. We can discuss market positioning and preparation options while your attorney determines when a sale can proceed. Avoid promising a closing date before the legal and title requirements are understood.

What can affect the timeline?

Appointment proceedings, missing records, title issues, disputes, property condition and buyer financing can affect timing. We keep the marketing and contract milestones aligned with information from counsel rather than treating an accepted offer as a guaranteed closing.

Questions families ask

Can I sell because I am named executor in the will?

Do not assume that the nomination alone is sufficient. Ask your attorney to verify appointment, the applicable documents and authority to sell this property.

Does every inherited home need probate?

No single answer applies to every title arrangement. Have counsel review the deed, any trust and the circumstances of ownership before choosing a process.

Can we get a home valuation before the estate is ready to sell?

We can discuss market comparisons and condition with the appropriate authorization. A brokerage pricing discussion is different from a formal appraisal required for estate or tax purposes.
